首例网店逃税获刑2年
全国首例个人利用淘宝网交易逃税案昨日一审判决，被告人张某借公司名义在淘宝网上卖出近290万元含税商品，被普陀法院一审判决有期徒刑2年，缓刑2年；并处罚金6万元。<br /><br /> 张某是一家市场策划公司的经理，此前曾在淘宝网上购物，她发现网上交易不仅价格便宜，还可以不提供发票，不缴税，于是也做起了网上生意。<br />张某起初以公司的名义在淘宝网上注册了一个虚拟店铺，主要经营婴儿用品，通过淘宝网的支付宝进行交易。网上的生意越做越火，张某不久就自己在淘宝网上进行婴儿用品的买卖，并设立了私人的银行账户来进行交易。去年6月到12月，张某的交易额就达到500多万元，其中含税金额近290万元，按规定应缴纳11万余元的税款，张某却分文未缴。随后，检察机关以涉嫌偷税罪将张某的公司及其本人向法院提起公诉。<br /><br /> 法院审理后认为，被告为偷逃国家税款，采用不开具发票、不记账的方式，隐匿经营收入，不进行纳税申报，偷税数额达11万余元，其行为已构成偷税罪，依法应予处罚。考虑到张某具有自首情节，依法可减轻处罚，故作了以上判决，并判处被告单位罚金10万元。
